Hertz 24/7 UK Terms and Conditions of Membership and Rental

Hertz is offering you the opportunity to join a membership scheme for short term vehicle rental operated by Hertz 24/7. Your membership is a unique membership that allows you to access vehicles on an hourly basis and at a convenient location. Renting a vehicle has just become even easier.

As a member, we will ask each of you to respect not only the vehicle, but also these terms and your fellow members. This agreement and the terms and conditions below govern both other members and your membership and usage of the vehicles.

By agreeing to these terms and conditions, you agree to be bound by them and to receive notice of any changes to the terms and conditions through the posting of notice of such changes on the Hertz 24/7 website. We reserve the right to make changes to the terms and conditions (including but not limited to rates and charges) at any time. Your use of the Hertz 24/7 Car Club Service will be governed by and subject to the terms and conditions as published on the Hertz 24/7 website at the time of your use of the services. After we have published any changes to the terms and conditions you will be bound by those amended terms and conditions accordingly, you should check prior to each use of the services to ensure that you understand the precise terms and conditions applicable to your use of the services. If you make a booking, then you agree to the terms and conditions in force at the time of your booking.

Your membership:

1.     Becoming a member & using the Services

Application Process

                    a.    Members can register on-line, via one of our apps, over the phone, or by visiting selected Hertz branches. All details must be correct including your billing information.

                    b.    In order to receive confirmation and reminders on your bookings, you will need to provide a valid email address and your mobile phone number. Please inform us if these change during the course of your membership so that we can continue to keep you updated

                    c.    You need to ensure that at all times you fulfil our minimum rental qualifications. You must keep us up to date as to any change in billing details or contact information (Address & Phone Number). You are also required to notify Hertz of any driving infringements prior to using the services.

                    d.    You need to supply two photographs of your driving licence (front and back) together with a clear ‘head and shoulders’ shot of you holding the licence at the time of registration for the service. For applications made via our website, we ask you to send these photographs by email. If we do not receive these photographs less than 6 hours before your reserved pick-up time of the vehicle (or within 2 hours from your reservation, if your rental starts in less than 6 hours from the time of reservation), we will cancel your booking.

                    Minimum Rental Qualifications

                    e.    You must have a valid driving licence for at least a year and continue to maintain a valid driving licence for the duration of your membership.

                    f.    You must not have any serious endorsements (including DD, DR or UT on your licence) and you must not have had more than two accidents in the previous three years. To process your application we will have to check your licence with the Department of Vehicle Licensing Authority (DVLA) in order for us to validate your application.

                    g.    You will be required at the start of each rental to confirm that you continue to hold a valid driving licence permitting you to drive a vehicle in the UK and it is your responsibility to ensure that your driving licence remains valid and continues to comply with the conditions of paragraph 1(f).

                    h.    If you do not hold a UK driving licence, you can still become a member; please contact the Customer Care Centre for details.

                    Billing Details

                    i.    You will need to provide us with your Visa debit or credit card details so that we can verify their validity and then invoice you for rental fees and any additional charges.

                    j.    You will also be required to provide us with details of your home and business address.

                    Age Considerations

                    k.    The minimum qualifying age for Hertz 24/7 members shall be 23. Age qualifications may vary depending on local affiliations.

                    Young Driver – Additional Qualification requirements

                    l.    If you are under the age of 25, in addition to the above licence conditions, you will need to send to Hertz 24/7 the following information at the Customer Care Centre:

                    i.    Validation that you do not have any motor insurance claims in any name,

                    ii.   Letter from your insurance company confirming that you are named on the policy and that there are currently no claims in relation to the named person.

                    iii.    You will have to pay the young driver's applicable rate for each rental.

                    iv.  You will be responsible for damage, theft or vandalism to cars for up to £1000, or up to £1200 for one of our vans;

                                      Non – waivable Car Excess £1000

                                      Non – waivable Van Excess £1200                     

                               v.   If you put the wrong fuel into the vehicle, you will be charged the excess amount. If the vehicle is stolen, you will be charged the full excess amount. In the event that the theft is considered “Gross    Negligence” Hertz 24/7 reserves the right to pursue for the full cost of repairs or vehicle value.

                   vi.      Please remember that the additional protection plan only covers you as long as you have followed the rules of the membership and have used the vehicle in accordance with the terms and conditions AND the damage was not caused intentionally, by gross negligence of you or an authorised driver.

                    m.      Once we have approved and authenticated your details, you will become a member of Hertz 24/7. We reserve the right not to accept your application for membership on any grounds.

                    n.    Please note if you are using the Hertz 24/7 service as part of an agreement with a Company or University you will be subject to the locally agreed age restrictions. Please contact your Company, University or Hertz 24/7 to confirm any specific terms and conditions that may have been agreed.

2.     The Vehicle Entry Device

a.    When we confirm your membership, we will issue you with your own Vehicle Entry Device which will be mailed to the address which you provided in your application.

b.    The Vehicle Entry Device will be used to both lock and unlock the vehicle each time you use it.

c.    You must not give, lend or sell the Vehicle Entry Device to anyone else nor let anyone else use it to drive a Hertz 24/7 vehicle. If you do not comply with this condition any insurance/coverage will be void and you will be liable for the full amount of any damage or loss incurred as a result of your breach.

d.    If you require a replacement Vehicle Entry Device Let us know as soon as possible and we can send a replacement, Please see the schedule of charges at the end of this agreement for the associated charges for replacement access devices.

3.     Making a Booking

a.    To reserve a vehicle you must add a valid method of payment to your profile.

b.    You can reserve your vehicle at our website www.hertz24/7.com using the Hertz 24/7 App on your smart phone, or by phoning the Customer Care Centre. Phone Reservations will incur a booking fee. The Customer Care Centre is open Monday to Sunday from 07:00 – 22:00.

c.    You must book the vehicle for at least one hour on each occasion. Thereafter in agreed intervals,

d.    Certain vehicles and locations may become available for one-way rentals. These will be identified on the Hertz 24/7 website.

e.    You will receive a confirmation of your booking by text message on your mobile and an email, depending on your contact information options.

f.    Feel free to look at the FAQs or contact the Customer Care Centre for further details.

4.     Charges for using the vehicle

a.    When you use the vehicle, you will be charged on an hourly rate or part thereof with a minimum charge of one hour. You will be charged for the full rental, regardless of whether you returned the vehicle early, subject to clause 6.

b.    The rental rate for each rental will be determined when you make a booking and you will be able to view these charges before you confirm each booking.

c.    While the Rental Agreement is in force I will be liable as owner/hirer of the vehicle, or any replacement vehicle, for any fixed penalty offence, penalty charge notice, notice to owner, parking charges and associated administration charges for that vehicle under s66 Road Traffic Offenders Act 1988, Schedule 6 Road traffic act 1991, Traffic Management Act 2004, Protection of Freedoms Act 2012 and any other relevant legislation.

d.    Mileage will be charged at an agreed rate (dependant on the vehicle booked) up to the manufacturers recommended vehicle range on a full tank of fuel on any given rental transaction. After this point any additional refuel costs are the responsibility of the renter.

e.    The charges applicable for one way rentals (where available) may change from time to time and will be presented to you at the time that you make a reservation.

f.    When you make a reservation for a vehicle situated in a country outside of the United Kingdom, you will be charged in the currency of the country in which you joined Hertz 24/7.

g.    We will preauthorise up to 200% of the initial charges forty-eight (48) hours before you start your rental or immediately, if your rental commences in less than 48 hours. The booking will only be confirmed once preauthorisation amount has been successfully obtained. Hertz 24/7 will release the preauthorisation amount the same day as the vehicle is returned once all charges have been deducted, however it may not appear in your account immediately, depending on your bank’s policy. On average it takes 4-5 days for this to appear back in your bank account, but can take up to 30 days- please refer to your bank’s policy for details.

h.    Your account will be debited at the end of the rental for the rental charges and any additional charges which may be applicable. If the payment fails, you will be charged an administration fee. Please refer to the schedule of charges at the end of this agreement.

i.    If you make a booking through the Customer Care Centre, you will be charged an additional booking fee. Please refer to the schedule of charges at the end of this agreement.

j.    If you are under 25 years of age, the young driver's hourly rate will be applicable for your rental.

k.    By agreeing to these terms and conditions, you authorise us to preauthorise the initial charges and deduct all charges from your Visa debit or credit card you provided.

5.     Additional charges that you will be responsible for

Please see Schedule 1 below for the detail of the Charges

a.    If you return the vehicle late, you may be charged the rental fee, plus a late return fee, plus an incremental hourly rental fee for any overtime.

b.    You will also incur an additional charge in the following instances:

i.    If you return the vehicle with less than a quarter tank of fuel.

ii.   If you leave the vehicle in an unfit state (not clean), or you have smoked in the vehicle or allowed pets into the vehicle.

iii.  If you lose the keys, vehicle documents or the fuel card.

iv.  If you have not closed the windows, turned the lights or radio off, or if you forgot to lock the vehicle.

c.    If you do not return the vehicle to the designated parking space and park the vehicle somewhere else and don't inform us, then you will be charged an additional fee, any parking charges and any recovery charges if the vehicle is towed away.

d.    If we are required to process any accident claims, road fines, parking fines or any other fines relating to the time the vehicle was in your possession or left parked after your rental, prior to the vehicle being rented out again, you will be charged an administration charge for dealing with it. You will also be responsible for paying any fines.

e.    By agreeing to these terms and conditions, you authorise us to deduct all charges from your credit or Visa debit card.

6.     Early return/Cancellation

a.    If you no longer need the vehicle, you may cancel the booking. To avoid being charged for the full period of the booking, you must cancel at least six hours before the time of your booking. If you don't cancel before six hours, you will be charged for up to 24 hours or your full rental, whichever is the lower amount.

b.    Even if you return the vehicle early, you will still be charged for the full rental or for the period up to 24 hours after the return, whichever is less.

7.     Our Commitment to You as a Member

a.    Vehicles will be available to you from designated parking spaces from the start of your booking. Other members may be returning the vehicle at the end of their booking. We cannot always guarantee that the vehicle which you have reserved will be available.

b.    If a vehicle has not been returned on time by a previous member, we will try and find an alternative solution for you, but we may not be able to meet all your requirements.

c.    We will ensure that as far as reasonably possible, the vehicle is in a good overall operating condition.

d.    If a vehicle breaks down, let us know immediately by contacting the Customer Care Centre and we will arrange for a breakdown service provider to come to you or make alternative arrangements.

8.     Invoicing

a.    You are responsible for the payment of all charges in any way incurred in connection with the booking and use of a vehicle.

b.    When you joined, or before making a booking, you gave us your Visa credit/debit card details. You must notify us immediately if these details change. If we cannot authorise your payment card before each rental, you will not be able to unlock and use the vehicle.

c.    At the end of every rental, we will debit your account for the rental charges and any additional charges, insurances, and/or damage.

d.    We will not be responsible for any overdraft charges or any other losses or liabilities which you may incur with your bank or card provider.

e.    If we experience problems with your credit card or other invoice payment, or in the event of debit refusal by your bank, we reserve the right to suspend and/or terminate your membership of Hertz 24/7. You will also be charged an administration fee for each collection attempt until full payment has been received.

f.    When you give us your credit or Visa debit card details you agree to allow us to deduct from your card for all charges that you may have incurred.

9.     Insurances and Additional Protections Offered by Hertz 24/7

a.    Provided you comply with the terms and conditions of rental, you will be covered by third party motor insurance as required by law and damage protection.

b.    When you join you agreed to the additional damage protection plan that Hertz 24/7offers you when you use the vehicle which is part of your membership. Please see below in Schedule 2 for the details and the terms and conditions of the protection plan.

c.    If you have followed all the rules of Hertz 24/7 membership, you will only have to pay up to the excess if there is damage, loss or theft of the vehicle. If the damage is lower than the amount of the excess, you will have to pay the amount of repair and an administration fee. If we cannot assess the cost of the repairs at the time of damage notification we will bill you for the full excess amount and refund the difference after the repairs have been completed.

d.    If you do not comply with the terms and conditions of rental, or if the loss, damage or theft is caused intentionally or by gross negligence, you will lose the benefit of any insurance/cover and the additional protection provided by Hertz 24/7. All roof damage will be considered the responsibility of the member and all such damage will be categorised as gross negligence.

e.    It is important that you notify us by email or normal mail of any change in your licence status or if you have any points added to your licence as this may mean that you are no longer insured.

f.    If you use the Hertz 24/7 services outside of the UK the local Terms and Conditions of rental within that country will apply. For the avoidance of doubt Hertz 24/7 members residing outside of the UK will abide and be bound by UK terms and conditions when renting in the UK.

10.    Termination and Suspension of your Membership

a.    Your membership is for life, unless you notify us that you wish to cancel or we choose to terminate it.

b.    You may cancel your membership at any time. We will terminate your membership and cease to send you any updates and special offers.

c.    We may suspend your membership in the event that you have failed to pay your account or the direct debit payment was unsuccessful.

d.    We may also suspend your account if your driving licence no longer meets our licence requirements for you to use our vehicles.

e.    We may also choose to terminate or suspend your membership at any time for any other reason including if we feel that you have been abusing the services or are not following the proper rules.

11.    Your Information - Data protection

a.    When you fill in your application details, you agree to us using them to undertake a credit check with Experian and agree that Experian may check your details against any database (public or otherwise) to which they have access and may also use your details in the future to assist other companies for verification purposes. A record of the search will be retained.

b.    We will also use the licence details which you give us to check with the Licence Authorities that you can use our vehicles and you consent to us disclosing the information to the Licence Authorities to enable us to confirm your membership.

c.    We may continue to do periodic checks to ensure that your licence remains valid and still fits our membership requirements.

d.    To make sure that you are fully up to speed with all the fantastic developments at Hertz 24/7, we will send you regular updates and new offers by email, text message or by post so that you can make use of them and these will be sent to the details which you provided in your enrolment.

e.    By agreeing to these conditions, you authorise us to debit your account for all rental charges and any additional charges as per the statement which we shall provide to you before debiting your account.

f.    We track the location of the car via GPRS for security purposes and to provide the Hertz 24/7 services, and accordingly you confirm that we can keep this data for such reasons.

g.    We will only show your credit / Visa debit card details to our third party payment partners.

h.    Please read our privacy policy for the measures which we have in place to make sure that all your details are protected.

i.    The data controller in relation to any information which we have been given by you is Hertz (UK) Limited with its registered address at Hertz House, 11 Vine Street, Uxbridge, Middlesex, UB8 1QE.

j.    You agree that we may process your information as defined under the Data Protection Act.

k.    You also agree that we can keep the information as part of our records to continue to administer and provide the services to you.

l.    We will send you the latest offers and any material relating to such and you will be provided with the opportunity to unsubscribe should you no longer wish to receive the offers.

12.     Disputes

a.    All disputes should be e-mailed to HertzUK24/7@hertz.com within 5 days of the rental concluding. The Hertz 24/7 team shall endeavour to respond to your query within 48 working hours.

b.    If we cannot resolve the dispute directly with you, this agreement will be governed by the laws of England and Wales and you agree that the courts of England are the most appropriate and convenient courts to settle the dispute.

13.     Before using the Vehicle

a.    You must check the vehicle for any damage and make sure that you report any damage to the Customer Care Centre before using the vehicle. If you do not inform the Hertz 24/7 team prior to using the vehicle you may be liable for any damage to the vehicle.

b.    If you don't let us know, you will be responsible for any damage and we will deduct any costs and expenses from your agreed method of payment.

c.    You must also check that the fuel card, parking card, and the vehicle condition/damage report are in the vehicle.

d.    You will be required to verify that you continue to hold a valid driving licence at the start of each rental.

14.     Conditions when using the vehicle

a.    You must use the Vehicle Entry Device to unlock the vehicle and to lock the vehicle when you are not driving the vehicle. You will not be able to access the Hertz 24/7 fleet without your assigned access fob.

b.    The keys must not be removed from the vehicle when you leave the vehicle.

c.    You are responsible for the vehicle and anything that happens to the vehicle from the moment that you unlock the vehicle until your rental is completed and you lock the vehicle. This includes tyre damage that may not be evident at the time of ending your rental.

d.    You are responsible for any tolls, parking fines, bus lane fines, speeding fines, clamping fees, and any other charges or fees which are incurred while using the vehicle.

e.    You must not smoke or allow anyone else to smoke in the vehicle.

f.    No pets are allowed in the vehicle at any time, except if required as a service animal for the visually impaired.

g.    Remember that another member will use the vehicle after you, so keep it clean and tidy.

h.    Please look at the online FAQs for any additional information on using the vehicle.

i.    If damage is done to the vehicle, you are responsible, and you must let us know immediately if anything happens.

j.    If the vehicle breaks down, or there is a fault with the vehicle, you must let us know immediately. Do not arrange for your own breakdown repair service or allow any other person to service or fix the vehicle.

k.    If you have an accident you must fill an incident report form in the glove box and inform the police if required. If the vehicle is stolen you must inform the police Immediately. Let us know straight away and we will tell you what to do. You should not add or attach any equipment or device to the vehicle.

15.     Returning the Vehicle

a.    You must return the vehicle before the end of your rental period; otherwise, a late return fee will be applied.

b.    Rental charges will continue to accrue; until the vehicle is returned to its parking space and the rental is closed. For early return, please see clause 6b.

c.    Ordinary wear and tear due to reasonable use expected, you must return the vehicle in the same condition in which you received it. You can find a copy of this guide at www.bvrla.co.uk, as well as on the back of the Hertz 24/7 Vehicle Pre Inspection sheet. All roof damage is the responsibility of the member who will be fully liable for the cost of repair regardless of any insurance waivers purchased.

d.    At the end of the rental, please conduct a final check and inspect the vehicle for any damage which may have occurred during your rental. If any new damage is detected, you must report it to the Customer Care Centre.

e.    The vehicle must be parked in one of the Hertz 24/7 parking bays at the same location where you picked up the vehicle, unless you have booked a one way rental, in which instance, you must return the vehicle to the Hertz 24/7parking bay at the designated location confirmed with you at the time of reservation.

f.    If you cannot park in the designated parking space, phone the Customer Care Centre immediately to notify them where you are parking the vehicle.

g.   Fuel cards are provided within 24/7 vehicles. Mileage will be charged at a set price per mile, check at time of booking for mileage cost.

h.    Hertz may in agreement with certain affiliate groups provide a fuel card. You must make sure that there is at least a quarter of a tank of fuel for the next member. If you need to refuel the vehicle, you must use the fuel card and use the correct fuel. All fuel cards have restrictions applicable, these are clearly displayed on the card. It is your responsibility to not exceed this limit. Should you exceed this limit it is your responsibility to arrange payment for the fuel. You should then retain the receipt and subject to agreement from the Hertz 24/7 team seek reimbursement.

i.    Turn off the lights of the vehicle and the radio and close any open windows.

j.    Remember to leave the keys, the fuel card, the parking card, and the Vehicle Pre Inspection sheet in the vehicle and lock the vehicle using the Vehicle Entry Device.

k.    At the end of the rental, on each occasion, you must ensure that you terminate the rental by turning off the engine, removing the key from the ignition and then answering the question on the screen pad - confirming that you wish to "end the rental’. Failing to do so may result in additional charges.

16.     Your Responsibilities as a Member

a.    You are responsible for the vehicle and anything which happens to the vehicle from the moment that you unlock the vehicle with the Vehicle Entry Device.

b.    You must not use the vehicle to drive outside of the United Kingdom.

c.    You must only use the vehicle to carry passengers which do not exceed the designed seating capacity.

d.    You must only use the vehicle in accordance with all highway and other applicable laws and regulations.

e.    The use of the vehicle in the following conditions is not allowed:

i.    for any hire or reward,

ii.   to carry passengers for remuneration,

iii.  for off road or on roads which are unsuitable,

iv.   to take part in any race or contest,

v.    to sub-rent or for driver training,

vi.   by any person who is under the influence of alcohol or any drug or medication which is prohibited,

vii.  in the carrying out of any crime or any other illegal activity,

viii. for the towing of a trailer or vehicle,

ix.   To carry any substance which is toxic, flammable, or which may damage the vehicle.

f.  If you don't comply with the terms and conditions of use of the vehicle, you will lose the benefit of any insurance cover and additional protection which you may have.

g.  You must continue to meet all our licence requirements while you are a member and whenever you use the vehicle and to let us know if there are any changes to your licence status.

17.     Applicable Law and Renting Outside of the UK

a.    If you wish to rent a Hertz 24/7vehicle outside of the UK, then you must ensure that your driving licence is valid in the country of destination and permits you to drive vehicles in that country. If you are licensed by a country which does not permit us to obtain a copy of your driving record or we cannot confirm your licence details with the licensing authorities, then you must submit a copy of your driving record to the Customer Care Centre.

b.    When you first make a reservation for the vehicle in a new country, we may require you to submit additional information to the Customer Care Centre.

c.    This agreement and the terms of your membership are with Hertz (UK) Limited and the law of England and Wales will apply and you agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.

d.    If and when you make a reservation for a vehicle outside of the United Kingdom, then the conditions of membership and use shall be governed by these terms and conditions, subject to any additional terms and conditions which you will be asked to agree to when you first make a booking in that territory. The booking and rental of the vehicle will then be with the Hertz 24/7 company in the territory where you pick up the vehicle, but your membership obligations shall remain with Hertz (UK) Limited.

SCHEDULE 2 – ADDITIONAL PROTECTION PLAN

Why do I need to take this out?

When you drive the vehicle, you are only insured and protected against any claims from any third person for death, personal injury or damage to property caused by the vehicle during your rental.

You are not protected against any damage done to the vehicle itself, vandalism or theft of the vehicle. The Additional Protection Plan covers you for these situations.

What protection will I get?

You will be responsible for damage or vandalism to cars for up to £1000 per incident, or up to £1200 for one of our vans per incident;

Non-waivable Van Excess per incident £1200

If the damage to the vehicle is less than excess amount, you will only be responsible for the lesser amount, any administration fee and any towage costs. Any damage more than the excess amount will be covered by Hertz 24/7.

If you put the wrong fuel into the vehicle, contaminate the fuel tank or contaminate the Ad blue tank all such damage will be categorised as gross negligence and you will be liable for the cost of repair. If the vehicle is stolen you will only be charged the excess amount.

All roof damage will be considered the responsibility of the member and all such damage will be categorised as gross negligence.

Please remember that the additional protection plan only covers you as long as you have followed the rules of the membership and have used the vehicle in accordance with the terms and conditions AND the damage was not caused intentionally, by gross negligence of you or an authorised driver.
